Monkey Kitchen Cocktail Competition Terms & Conditions
These terms and conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of the terms and conditions.
By participating, all entrants will be deemed to have accepted and be bound by the terms and conditions. If applicable, the winner’s guest must also comply with these rules. Please retain a copy for your information.

This promotion is open to residents worldwide aged 25 or over* (at their date of entry), excluding employees and their immediate families of the Promoter (or, if not the Promoter, the prize provider), its subsidiaries, other group companies or agents, or anyone else professionally connected with this promotion.
The Promoter may verify any details of any entrant, the winner or the winner’s guest.
*competition requires compliance with local LDA and subject to local market regulation.
4. Limit on entries
There is a limit of one entry per week. Anyone trying to circumvent this rule will be disqualified from this promotion and any prize award will be void. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted.
5. Social media
Internet access is required and entrants must have an active Instagram account. If you do not have an account you will need to create one to participate. You will require an active email address in order to do this.
Your use of Instagram to enter this promotion is subject to the platform’s terms and conditions.
Entrants acknowledge that any promotion run via a social media channel is in no way sponsored, endorsed or administered by, or associated with, that social media channel. By entering, entrants agree to release that social media channel from any and all liability in connection with the promotion. Entrants also understand that any personal details they submit to enter a promotion or claim a prize are provided to the Promoter and not to that social media channel.
6. Promotional period
The promotion will run from 00:00 21/04/20 to 23:59 27/06/20 (10 weeks) (GMT UK time).
Any entries received before the start date or after the closing date (for whatever reason) will be invalid.
7. How to enter
No purchase is necessary to enter the promotion or to claim the prize
Entry instructions will be available in the body of our original Instagram post.
To enter: Capture a video of yourself making a cocktail, upload the video file to www.wetransfer.com from your mobile. Copy the wetransfer download link & paste into a direct message to the Monkey Shoulder Instagram account @monkeyshoulder.

Videos containing no William Grant & Sons brands will not be entered into the competition.
Anyone entering more than once using multiple handsets, multiple identities or computerised (automated) system will be disqualified from the promotion.]
8. General rules on entry
Incomplete, incorrect, illegible, inaudible, misdirected, lost, damaged, late or otherwise deficient entries will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.
Your entry will be deemed invalid and disqualified if it: -
- contains unlawful, defamatory, discriminatory, malicious, indecent or other inappropriate content;
- includes the names or images of any individual without their express permission;
- in the reasonable opinion of the Promoter, causes any widespread or serious offence;
- contains content deemed socially irresponsible including the promotion of excessive consumption of alcohol; features or refers to children;
- made by an entrant using a false name; or
- is made on someone else’s behalf.
If entry is through a promotional website, you are required to follow any other specific instructions on the promotional website.
Internet service providers’ fees may apply when accessing the internet. By using the promotional website, you also agree to the website’s terms and conditions.
There are 40 x £100 of prizes in total for the entire promotion.
The prize is £100 per winner (4 winners per week for 10 weeks), These winners will have their video posted on the@MonkeyShoulder Instagram account & each winner will be paid £100 via our agency partner SPACE by direct bank transfer. Winners transfer details will be requested by the agency within the Instagram messenger dialog. All personal details will be destroyed/deleted immediately after transfer.
10. General rules on prizes
The Promoter will not be liable for any prizes which are lost, delayed or damaged when in transit to the winner.
Where prizes are provided by third parties, the prize may be subject to the terms and conditions of that third party.
The Promoter may substitute any prize (or an individual aspect of a prize) for an alternative of equal or greater value where it deems it strictly necessary due to events outside its reasonable control.
Winners may not transfer the right to accept their prize to another person without the Promoter’s consent.
Prizes are not negotiable.
11. Winner selection
Entries will be judged on the following criteria:
- Drink recipe
The Promoter’s selection of each winner is final.
The videos will be judged on/after day 5 of each competition week by a panel including at least one judge who is independent from the Promoter. The winning 4 videos each week throughout the competition be uploaded within the next following 7 days. This will repeat until the end of the competition (10 weeks)
12. Winner notification
Winners will be contacted directly through an Instagram direct message.
Entrants are encouraged to monitor their connections during this time in case they are the winner.
Each prize must be claimed by 31/07/20. If the prize is not claimed by this date, the winner will have no entitlement to the prize.
13. Publicity/name release
The winner agrees to take part in publicity in connection with this promotion and to allow the Promoter to publish their name and location in the prize winners list.
If required by a regulatory authority, and/or if we consider it lawful, necessary or appropriate to do so, we may elect to make available a list of winner’s surname and/or county to members of the public or regulators who request such details within 3 months of the closing date of this Promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting email@example.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winner’s list by emailing firstname.lastname@example.org . We reserve the right to refuse any or all such requests. Please mark the request “FAO: Joe Petch – Monkey Global Brand Ambassador– Monkey Kitchen Cocktails”.
The Promoter reserves the right to verify all entries including, but not limited to, asking for address and identity details (which they must provide within 14 days).
The Promoter may:
. refuse to award a prize;
. withdraw prize entitlement;
. refuse further participation in the promotion; and/or
. disqualify the participant,
where there are reasonable grounds to believe the entrant has broken these terms and conditions, won using fraudulent means or otherwise gained unfair advantage.
All entries become the property of the Promoter, and none shall be returned.
Entrants must ensure their video submission:
(i) is not copied from a third party;
(ii) does not otherwise infringe a third party’s intellectual property rights;
(iii) does not feature any person (living or dead) without their permission; and
(iv) does not contain any defamatory, obscene, offensive, hateful, illegal or otherwise unsuitable materials.
You will retain any copyright which exists in your submission but, by entering, entrants licence and grant the Promoter an exclusive, royalty free, perpetual, worldwide, irrevocable and sub-licensable right to use your content for any purpose in any media, without compensation, restriction on use, attribution or liability.
Participants agree not to assert any moral rights in relation to such use.
Participants warrant that the materials contain no third party materials, are their original works, have not been copied, in whole or in part, from any third party and they have full authority to grant these rights.
16. Social media disclaimers
This promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. By entering the promotion, all participants accept that they have no claim against Instagram. By entering the promotion, all participants agree to a complete liability release for Instagram.
Numerous factors outside the control of the Promoter may interfere with the operation of Facebook, Twitter and Instagram. The Promoter does not guarantee continuous, uninterrupted or secure access to these websites.
17. Tax liability (trade only)
Any tax liability arising from receipt of the prize will be the responsibility of the recipient.
If for any reason any aspect of this promotion is not capable of running as planned (including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion), the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries/claims.
If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation. In these circumstances, the Promoter may immediately terminate the promotion without any liability.
Except for any liability which cannot be excluded by law (in which case that liability shall be limited to the minimum allowable by law), the Promoter and its associated agencies and companies will not be liable for any loss (including indirect, special or consequential loss or loss of profits), expense or damage which is suffered (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize.
19. Brand protection
The winner must not do anything which could, in the reasonable opinion of the Promoter, bring the Promoter or its brand into disrepute before, during or after this promotion.

If any of these clauses are determined to be illegal, invalid or otherwise unenforceable, then it shall be deleted from these terms and conditions. The remaining clauses shall survive and remain in full force and effect.
These terms and conditions are governed by English law. The Courts of England and Wales will have exclusive jurisdiction.
21. Data protection
The Promoter will use the personal details supplied by entrants for the administration of the promotion, which may involve transferring that information to third parties involved in the administration of the promotion (e.g. the Promoter’s marketing agency) and, in the case of winners, the fulfilment of the prize.
The personal details entrants submit must be true and up-to-date.
You can request access to your personal data, or have any inaccuracies rectified, by sending an email to DataProtection@wgrant.com.
If you are required to submit a third party’s personal data to enter the promotion, you must ensure that the person whose details you submit has given their consent for you to provide the Promoter with their personal data.
